Welcome to Shoptailorly ("we", "us", "our"), a custom jersey service provider operating the website (the "Site") and offering personalized sports apparel and related services (the "Services"). By accessing, browsing, or using our Site and Services, you ("you", "your") agree to be bound by these Terms of Service (the "Terms"), along with our Privacy Policy, Shipping Policy, and Returns & Refund Policy, all of which are incorporated herein by reference. 1. Acceptance of Terms

By using our Site or Services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using our Services on behalf of a business, team, or organization, you represent and warrant that you have the authority to bind that entity to these Terms. We reserve the right to update, modify, or revise these Terms at any time. Any changes will be posted on this page with an updated "Last Modified" date, and your continued use of the Site or Services after such changes constitutes your acceptance of the revised Terms. 2. Account Registration and Security

To access certain features of our Services (such as saving custom designs, tracking orders, or viewing order history), you may need to create an account. When registering an account, you agree to provide accurate, complete, and up-to-date information, including your name, email address, and any other required details. You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities conducted under your account. You agree to notify us immediately at service@shoptailorly.com if you suspect any unauthorized access to or use of your account. We shall not be liable for any loss or damage arising from your failure to protect your account credentials.

3. Services and Custom Orders

Shoptailorly provides custom jersey design and production services, allowing you to create personalized apparel based on your specifications (including designs, colors, logos, names, numbers, and sizes). By placing a custom order, you agree to the following:

You have reviewed and approved the design proof provided by us before production begins. Any errors or discrepancies in the design that are not reported to us prior to production are your responsibility.
All custom orders are non-cancelable once production has started, except as outlined in our Returns & Refund Policy. If you cancel an order after 24 hours of placing it, a cancellation fee of $20 per item will be charged.
We reserve the right to refuse or cancel any order that we reasonably believe violates these Terms, contains offensive, inappropriate, or infringing content, or is otherwise inconsistent with our business standards.
Minor variations in color, stitching, or printing may occur due to the custom nature of our products and the limitations of manufacturing processes. These variations do not constitute a defect and are not eligible for returns or refunds.

4. Payment Terms

All payments for orders must be made in full at the time of checkout, using the payment methods we accept (e.g., credit card, debit card, PayPal). By providing payment information, you represent and warrant that you are authorized to use the payment method and that the information provided is accurate. We reserve the right to charge additional fees for rush processing, expedited shipping, or special customization requests, which will be clearly stated at checkout. If a payment is declined or fails to process, we may cancel your order without prior notice. You are responsible for any fees or charges incurred due to failed payments (e.g., bank fees, overdraft fees).

5. Intellectual Property

All intellectual property rights in the Site, Services, and our proprietary designs, logos, trademarks, text, and graphics (collectively, "Shoptailorly IP") are owned by or licensed to Shoptailorly. You may not copy, reproduce, distribute, modify, or use any Shoptailorly IP without our prior written permission. By submitting custom designs, logos, or other content to us, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and modify such content solely for the purpose of producing your custom order. You represent and warrant that you own or have the necessary rights to use all content you submit, and that such content does not infringe on the intellectual property rights of any third party. We shall not be liable for any claims arising from your submission of infringing content.

6. User Conduct

When using our Site and Services, you agree to conduct yourself in a manner that complies with these Terms and all applicable laws and regulations. You shall not:

Submit content that is offensive, discriminatory, harassing, violent, illegal, or infringing on the rights of others.
Use the Site or Services for any fraudulent or unauthorized purpose, including but not limited to placing fake orders or stealing payment information.
Attempt to access, modify, or disrupt the Site’s technical infrastructure or security systems.
Impersonate another person or entity, or mislead us or other users about your identity or affiliation.

We reserve the right to terminate your account and refuse Services to you if you violate these conduct rules.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Shoptailorly shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Site or Services, including but not limited to damages for lost profits, lost data, or personal injury. This limitation applies regardless of whether the damages arise from negligence, breach of contract, or any other legal theory. We shall not be liable for any delays in delivery, defects in products, or errors in customization that are due to circumstances beyond our control (e.g., carrier delays, natural disasters, or your failure to provide accurate design details). Our total liability to you for any claim arising from these Terms or the use of our Services shall not exceed the total amount paid by you for the relevant order.

8. Indemnification

You agree to indemnify, defend, and hold harmless Shoptailorly, its employees, directors, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from: (i) your use of the Site or Services; (ii) your submission of infringing or inappropriate content; (iii) your violation of these Terms or applicable laws; (iv) your breach of any representations or warranties made herein; or (v) any third-party claims related to your custom orders or use of our Services.

9. Termination

We may terminate or suspend your access to the Site or Services at any time, without prior notice, if you violate these Terms, engage in fraudulent or unauthorized activity, or if we determine that your use of the Services is harmful to our business or other users. You may terminate your account at any time by contacting us at service@shoptailorly.com. Upon termination, all licenses granted to you under these Terms shall immediately terminate, and you shall cease using the Site and Services. Sections 5 (Intellectual Property), 7 (Limitation of Liability), 8 (Indemnification), and 11 (Governing Law) shall survive termination.

10. Privacy

We collect and use your personal information in accordance with our Privacy Policy. By using our Site and Services, you consent to the collection, use, and disclosure of your information as outlined in the Privacy Policy. We take reasonable measures to protect your personal information, but we cannot guarantee absolute security.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms, the Site, or the Services shall be resolved through arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association, or through small claims court if applicable. You agree to submit to the exclusive jurisdiction of the courts of California for any disputes that are not resolved through arbitration.

12. Miscellaneous

These Terms constitute the entire agreement between you and Shoptailorly regarding your use of the Site and Services, and supersede all prior or contemporaneous agreements, representations, or understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or any other provision.
We may assign these Terms to any third party without your prior consent, but such assignment shall not affect your rights or our obligations under these Terms.
